Terms & Conditions

These terms and conditions set out the agreement between the member and the Muslim Welfare Organisation (MWO) for participation in the Death Committee Membership. By applying for membership you confirm you have read, understood and agreed to these terms. These terms are governed by the laws of England and Wales.

1.Definitions

In these terms:
1.1. “Member” means any person accepted into the Death Committee.
1.2. “Family Membership” means a membership that includes a married couple or one/two parent(s) or guardian(s) and their children who reside at the same address.
1.3. “Membership Year” means the calendar year from 1 January to 31 December.

2.Membership eligibility

2.1 Membership is available only to Muslims permanently resident in the United Kingdom.
2.2 Proof of residency and identity may be required.
2.3 MWO reserves the right to accept, refuse or terminate any application at its sole discretion. MWO is not required to give reasons.
2.4 Members must inform MWO of any change of residency, health or contact details.

3. Application and administrative donation

3.1 All applicants must complete the application form and pay a one-off administrative donation. The administrative donation is non-refundable.
3.2 The administrative donation amounts are set out on the Membership page and in the application form.

4. Annual donation and membership period

4.1 Annual donations must be paid in full upfront by bank transfer. For the initial membership year, the membership period shall commence on the first day of the first month of the year in which payment is received and continue until 31 December of that year. Thereafter membership will run on a calendar year basis from 1 January to 31 December, subject to payment of the annual donation.
4.2 Annual donations for subsequent years must be paid in full on or before 1 January of each membership year. Failure to pay may result in termination of membership.
4.3 All donations are non-refundable except as set out in clause 10.

5.Payment method

5.1 All donations shall be paid by bank transfer to the following account:

5.2 Members must use their name and postcode as the payment reference and should email proof of payment to [email protected] Annual donations for subsequent years must be paid in full on or before 1 January of each membership year. Failure to pay may result in termination of membership.
4.3 All donations are non-refundable except as set out in clause 10.

6.Funeral coverage and limitations

6.1 The Death Committee provides up to £3,000 towards the funeral costs of a deceased member.
6.2 If funeral costs exceed £3,000 the next of kin or family shall be responsible for the shortfall.
6.3 Payments will be made only upon receipt of a certified copy of the original death certificate.
6.4 Additional expenses such as repatriation outside the UK, extra caskets, flowers and other discretionary items are the responsibility of the deceased’s family.
6.5 MWO may provide guidance to the family to assist with Islamic funeral arrangements where requested.

7.Insufficient funds

If at any time the Death Committee Fund does not contain sufficient funds to meet funeral costs, the trustees may require active members to contribute equally to cover the shortfall.

8. Fund management and transparency

8.1 The Death Committee Fund is managed by MWO trustees who are responsible for investment and disbursement decisions.
8.2 Members may request annual statements of account.

9.Pre-existing medical conditions and disclosure

9.1 Membership may be terminated without refund where a member is later found to have failed to disclose a pre-existing or critical medical condition at the time of application.
9.2 Applicants who have been previously diagnosed with or treated for a critical condition are ineligible for membership.

10.Cancellation and refunds

10.1 Members may cancel their membership by submitting the MWO Death Committee Cancellation Form.
10.2 Refunds:
1. Cancellations made within 14 calendar days of joining: 90% refund of the membership donation (10% retained for administration).
2. After 14 days: no refund will be issued.

10.3 The one-off administrative donation of £100 is non-refundable.

11.Membership renewal and rejoining

11.1 Membership will lapse if payment of the annual donation ceases.
11.2 Lapsed members who wish to rejoin will be treated as new applicants and must pay the applicable fees.

12.Termination

MWO may terminate membership without notice or refund for any breach of these terms including fraud, non-payment or failure to meet eligibility requirements.

13. Nature of membership

Membership of the Death Committee does not constitute financial or legal advice. Members are advised to seek independent professional advice if required.

14.Complaints

14.1 Complaints should be sent by email to [email protected] or in writing to: MWO, 7 Upper High Street, Cradley Heath, West Midlands, B64 5HX.
14.2 MWO will investigate complaints in accordance with its internal complaint handling procedure and will seek to respond in a fair and timely manner

15.Dispute resolution

15.1 Members agree to attempt to resolve disputes by mediation in the first instance.
15.2 If mediation fails, disputes will be resolved under the Arbitration Act 1996 and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.Force majeure

MWO shall not be liable for failure to provide services caused by events beyond its reasonable control including natural disasters, pandemics or government restrictions.

17.Limitation of liability

MWO and its officers shall not be liable for:
• Delays or additional costs caused by third parties;
• Insufficient funds in the Death Committee Fund; or
• Errors or omissions in administration, except in cases of negligence or wilful misconduct.

18.Data protection

MWO will process personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. The Privacy Policy sets out details of how data is processed and members’ rights.

19.Fund closure

If the Death Committee Fund ceases, any remaining funds will be distributed proportionately among active members, subject to trustee discretion and availability of funds.

20.Governing law

These terms are governed by the laws of England and Wales and members submit to the exclusive jurisdiction of the English courts.
